Industrial Disability Retirement ( “IDR”)/ Disability Retirement(“DR”)
CalPERS’ Disability Retirement requirements for safety officers have become increasingly more complex and nuanced for public employers since CalPERS’ statewide audit in 2016, as well as , the issuance of the Circular Letter # 200-018-17 dated 03/30/2017 and Circular Letter # 200-014-23 dated 03/15/2023.
We are here to help public entities navigate CalPERS’ Retirement System.
MML represents and advises public entities throughout the State of California.
We provide in-depth review and guidance of policies, procedures and practices in relation to the management of disability retirements (IDRs and DRs) for Safety Officers.
We assist with all aspects of individual employee disability retirement applications, which includes, but not limited to, issues concerning:
ADPP
Haywood Investigations
obtaining IME/ SME Medical Evaluations specifically for IDR/ DR
submitting a public entity’s disability determination to CalPERS; and
re-evaluations pursuant to Cal. Govt. Code section 21192.
We consult, advise and attend Interactive Process (“IP”) Meetings of Safety Officers.
We litigate cases on behalf of Public Employers before the Office of Administrative Hearings ("OAH"), CalPERS Board, WCAB; and in Superior Court.
We provide educational presentations and training on the management of disability retirements for Safety Officers, and the interactions between Workers’ Compensation as well as ADA/ FEHA.
